Chapter Definitions:

Info: "Handgun" means any device designed or adapted to be fired with one hand.

Info: "Illegal Knife" means a:

  1. Knife with a blade over five and a half inches.
  2. A knife which is designed to be thrown.
  3. Dagger, including a dirk, stiletto and poniard.
  4. Bowie Knife
  5. Sword.
  6. Spear.

Info: "Club" means an instrument made or adapted for the purpose of inflicting serious injury or death by strike.

Info: "Short Barrel Firearm" means a rifle with a barrel length less than 16 inches or a shotgun with a barrel less than 18 inches, or any weapon that is made from a rifle or shotgun and has an overall length of less than 26 inches.


[15] [01] Unlawful Carrying Weaponry

Info: A person commits an offense if one intentionally, knowingly, or recklessly, openly carries on or about his person a:

  1. Handgun
  2. Unregistered Firearm: This includes a handgun or any other firearm which is registered to another person other than the one in possession.
  3. Illegal Knife
  4. Club
Unlawful carrying weaponry becomes a Felony Offense when the firearm is stolen, or registered to another person other than the carrier.
Felony Jail Time: 60 Seconds

Felony Fine: $4,375

Misdemeanour Jail Time: 45 Seconds

Misdemeanour Fine: $2,475

[15] [01] [Con] Non-applicable

The provisions of [15] [01] Unlawful Carrying Weaponry of this code do not apply to a person:

  1. In the actual discharge of one's official duties as a peace officer, a member of the armed force, national guard, or a guard employed by a penal institution.
  2. On one's private land under one's control, unless one is an agent of the owner acting as a security guard in which event one must comply with the subsection 4.
  3. Engaging in lawful hunting, fishing, or other sporting activity in which the weapon is commonly used.
  4. Who is a licensed security guard, on duty or enroute, in uniform with the weapon in plain view.

[15] [02] Places Weapons are Prohibited

Info: A person commits an offense if, with a firearm, intentionally, knowingly, or recklessly goes:

  1. On the premises of a school or an educational institution, whether public or private, unless pursuant to written regulations or written authorization of the institution.
  2. On the premises of a polling place on the day of an election.

Info: It is a defence prosecution under this section if the person was in the actual discharge of one's official duties as a peace officer or a member of the armed forces or national guard.

[15] [03] Unlawful Possession of Firearm by Felon

Info: When one has been convicted of a felony involving an act of violence or threatened violence, it is unlawful to posses a firearm away from the premises where one lives.

Unlawful Possession of Firearm by Felon is a Felony Offense.
Jail Time: 50 Seconds

Fine: $3,375


[15] [04] Prohibited Weapons

Info: A person commits an offense if one intentionally, knowingly, or recklessly posses, manufactures, transports, repairs, or sells any of the following:

  1. An explosive weapon.
  2. A machine gun.
  3. A short-barrelled firearm.
  4. A firearm silencer.
  5. A switchblade knife.
  6. Knuckle Dusters.

Info: It is defence that the conduct was was incidental to official duty by the armed forces or national guard, a governmental law enforcement agency, or a penal institution, or:

  1. The possession was pursuant to registration to the National Firearms Act.
  2. The conduct was incidental to dealing with a switchblade knife, springblade knife, or short-barrelled firearm solely as an antique.
Prohibited Weapons is a Felony Offense.
Jail Time: 30 Seconds

Fine: $6,375


[15] [05] Unlawful Transfer of Firearms

Info: An offense takes place when one:

  1. Knowing the weapon is to be used in the commission of an unlawful act, sells, rents, loans, or gives a handgun to any person.
  2. Knowingly sells, rents, loans, or gives or offers to sell, rent, loan, or give to any child under the age of 18 years.
  3. Knowingly or recklessly sells a firearm or ammunition to a firearm to any person who is intoxicated.
Unlawful Transfer of Firearms is a Misdemeanour Offense.
Jail Time: 25 Seconds

Fine: $3,175


[15] [06] Criminal Use of a Firearm

  1. Discharges a firearm within the limits of a residential area.
Criminal Use of a Firearm is a Felony Offense.
Jail Time: 50 Seconds
