[02] [01] Murder

(a) A person commits an offense if they:

  1. Intentionally or knowingly causes death,
  2. Intentionally causes serious bodily injury which leads to death or,
  3. Commits a felony and during the course of the felony causes death.
Murder is a Felony Offense.

[02] [02] Capital Murder

(a) A person commits a capital felony if they commit murder as defined in [02] [01] (i) and above and;

  1. The person murdered is a peace officer or FD worker who is acting in the lawful discharge of official duty and who the actor knows is a peace officer or FD worker.
  2. The murder is intentionally done in the course of committing or attempting to commit kidnapping, burglary, robbery, or arson.
  3. The murder is committed while escaping or attempting to escape from a penal insinuation; or
  4. While incarcerated in penal institution, he murders another who is employed in the operation of the penal institution.
Capital Murder is a Felony Offense.
Jail Time: 300 Seconds

[02] [03] Voluntary Manslaughter

(a) This occurs when one commits murder but acts under the immediate influence of a sudden passion arising from an adequate cause.

Voluntary Manslaughter is a Felony Offense.
Jail Time: 150 Seconds

Fine: $7,500


[02] [04] Involuntary Manslaughter

(a) Where one recklessly causes the death of another, or

(b) Where one is intoxicated due to the intoxication kills another while operating a motor vehicle.

Involuntary Manslaughter is a Felony Offense.
Jail Time: 100 Seconds

Fine: $7,500
