[08] [02] Theft of Service
Info: A person commits theft of service if, with intent to avoid payment for service by deception, threat, or false token; or
- One intentionally or knowingly secures performance of service by deception, threat, or false token.
- Holds property beyond the rental period.
Info: For the purpose of this section, intent to avoid payment is presumed if the actor fled without paying for the service in circumstances where payment is ordinarily made immediately upon rendering the service, as in hotels, restaurants, and comparable establishments.
Theft of Service is a Misdemeanour Offense
