Info: A person commits a capital felony if they commit murder as defined in [02] [01] and;

  1. The person murdered is a peace officer or FD worker who is acting in the lawful discharge of official duty and who the actor knows is a peace officer or FD worker.
  2. The murder is intentionally done in the course of committing or attempting to commit kidnapping, burglary, robbery, or arson.
  3. The murder is committed while escaping or attempting to escape from a penal insinuation.
  4. While incarcerated in penal institution, one murders another who is employed in the operation of the penal institution.
Capital Murder is a Felony Offense.
