[13] [01] Official Misconduct
Info: A public servant commits an offense if, with intent to obtain a benefit for one or to harm another, intentionally knowingly:
- Commits an act relating to one's office or employment that constitutes an unauthorized exercise of official power.
- Commits an act under color of one's office or employment that exceeds one's official powers.
- Refrains from performing a duty that is imposed on one's by law or that is to inherent in the nature of one's office or employment.
- Violates a law relating to one's office or employment.
- Takes or misapplies anything of value belonging to the government that may have come into custody or possession by virtue of one's employment, or secrets it with intent to take or misapply it, or pays or delivers it to any person knowing that such person is not entitled to receive it.
Official Misconduct is a Misdemeanour Offense.
